Hereinafter referred to as: “Mike on the Bike.”
GENERAL PROVISIONS
2. Applicability
2.1 These Terms & Conditions apply to all offers, products, services, travels, bookings, and agreements concluded via Mikeonthebike.com.
2.2 “Customer” means any natural person or legal entity entering into an agreement with Mike on the Bike.
2.3 Deviations from these Terms & Conditions are only valid if agreed upon in writing.
2.4 Any general terms and conditions used by the Customer shall not apply unless expressly accepted in writing.
2.5 Mike on the Bike reserves the right to amend these Terms & Conditions. The most recent version shall always apply.
PRODUCTS (WEBSHOP)
3. Offers and Formation of Agreement
3.1 All offers are non-binding and subject to availability.
3.2 Obvious errors or mistakes in pricing do not bind Mike on the Bike.
3.3 An agreement is concluded once the Customer receives an order confirmation by email.
3.4 Mike on the Bike reserves the right to refuse an order.
4. Prices
4.1 All prices are stated in euros and include VAT unless otherwise stated.
4.2 Shipping costs are shown separately during checkout.
4.3 For shipments outside the EU, import duties, local VAT, and administrative fees may apply. These costs are the responsibility of the Customer.
5. Payment
5.1 Payment must be made via the payment methods offered on the website.
5.2 If payment is not made on time, the Customer is automatically in default without further notice.
5.3 Statutory interest may be charged on late payments.
6. Delivery
6.1 Orders are shipped as soon as reasonably possible.
6.2 Delivery times are indicative and not strict deadlines.
6.3 Risk transfers to the Customer upon delivery.
7. Right of Withdrawal (Products)
7.1 The Customer has the right to withdraw from the agreement within 14 days after receiving the product, without giving any reason.
7.2 Return shipping costs are borne by the Customer.
7.3 The product may be unpacked and inspected as in a physical store. Use beyond what is necessary to assess the product may result in depreciation.
7.4 Refunds will be processed within 14 days after receipt of the returned product.
7.5 The right of withdrawal does not apply to:
Custom-made or personalized products
Sealed products once the seal has been broken
Products that cannot be returned for hygiene reasons
TRAVEL & MOTORCYCLE TOURS
8. Formation of Travel Agreement
8.1 A travel agreement is concluded once the booking has been confirmed in writing and a (down) payment has been received.
8.2 Mike on the Bike offers organized motorcycle trips, tours, events, and guided rides.
9. Payment for Tours
9.1 Upon booking, a deposit of 30% of the total tour price is required.
9.2 The remaining balance must be paid in full no later than 60 days prior to departure.
9.3 For bookings made within 60 days of departure, the full tour price must be paid immediately upon booking.
10. Cancellation by the Participant
10.1 All cancellations must be submitted in writing.
10.2 The following cancellation fees apply:
More than 90 days before departure: 30% of the tour price
Between 90 and 60 days before departure: 50% of the tour price
Less than 60 days before departure: 100% of the tour price
10.3 Participants are strongly advised to purchase appropriate travel cancellation insurance.
10.4 Due to the limited group size, accommodation reservations, guide services, and other tour-related commitments, no refund can be provided for cancellations made within 60 days of departure, regardless of the reason for cancellation.
10.3 Participants are strongly advised to take out cancellation insurance.
11. Cancellation or Changes by Mike on the Bike
11.1 Mike on the Bike may cancel a trip in case of insufficient participants or force majeure.
11.2 In such cases, the participant will receive a refund of payments made.
11.3 Mike on the Bike is not liable for additional costs such as flights or personal reservations.
12. Liability During Travel
12.1 Participation in motorcycle trips is entirely at the participant’s own risk.
12.2 The participant is responsible for:
A valid motorcycle license
Valid insurance
A technically sound motorcycle
Proper protective riding gear
12.3 Mike on the Bike is not liable for:
Accidents
Damage to motorcycles or property
Personal injury
Consequential damages
Theft
12.4 The participant indemnifies Mike on the Bike against claims by third parties.
12.5 Mike on the Bike is only liable in cases of intent or gross negligence.
13. Conduct During Travel
13.1 Participants must comply with traffic laws and instructions from the tour leader.
13.2 Dangerous or irresponsible behavior may result in exclusion from participation without refund.
WARRANTY (PRODUCTS)
14. Warranty
14.1 The Customer is entitled to statutory warranty rights.
14.2 Warranty does not apply in cases of:
Improper use
Incorrect installation
Drop or impact damage
Modifications
Normal wear and tear
PRIVACY
15. Privacy
Mike on the Bike processes personal data in accordance with applicable data protection laws. The privacy policy is available on the website.
FORCE MAJEURE
16. Force Majeure
16.1 Force majeure means any external cause beyond reasonable control.
16.2 This includes, but is not limited to:
Extreme weather conditions
War or political unrest
Pandemic
Government measures
Natural disasters
GOVERNING LAW & DISPUTES
17. Governing Law
17.1 All agreements are governed by Dutch law.
17.2 Disputes shall be submitted to the competent court in the district where Mike on the Bike is established.
